{"success":1,"message":"<div class=\"modal-dialog modal-lg\" role=\"document\">\n\t\t    <div class=\"modal-content\">\n\t\t      <div class=\"modal-header\">\n\t\t        <h5 class=\"modal-title\" id=\"modallabel\">Terms and Conditions<\/h5>\n\t\t        <button type=\"button\" class=\"close\" data-dismiss=\"modal\" aria-label=\"Close\">\n\t\t          <span aria-hidden=\"true\">&times;<\/span>\n\t\t        <\/button>\n\t\t      <\/div>\n\t\t\t<div class=\"modal-body\" id=\"termsmodal\">\n\t\t\t\t<div class=\"row\">\n\t\t\t\t\t<div class=\"col-md-12\"><p><strong>AllRegs Online - Single Family Guidelines for Encompass Terms and Conditions<\/strong><\/p>\r\n<p>Effective August 1, 2022<\/p>\r\n<p>These AllRegs Online - Single Family Guidelines for Encompass Terms and Conditions (these \"Terms\") are incorporated into the Master Services Agreement, Encompass Success Based Pricing Agreement, or Encompass SaaS Agreement (as applicable, the \"Agreement\") between ICE Mortgage Technology, Inc. (\"ICE MT\", \"we\", \"us\", or \"our\") and Customer (also referred to herein as \"you\" or \"your\"), and capitalized words used but not defined herein will have the meanings set forth in such Agreement. In addition to the terms in the Agreement applicable to all Services, these Terms apply to Customer&rsquo;s use of AllRegs Online - Single Family Guidelines for Encompass (\"SFG for Encompass\"). These Terms take effect when you agree to these Terms, enabling access to SFG for Encompass (\"Effective Date\"). You represent to us that you have validly entered into these Terms and have the legal power to do so.<\/p>\r\n<ol>\r\n<li><strong>Service Features.<\/strong>&nbsp;Customer may use SFG for Encompass to view and search certain mortgage industry information for its internal business purposes. SFG for Encompass is hosted on a website owned and operated by ICE MT.<\/li>\r\n<li><strong>Provision of the Service.<\/strong>&nbsp;Customer&rsquo;s subscription to SFG for Encompass is coterminous with its subscription to the Encompass Service. Subject to the terms and conditions of the Agreement and these Terms, during such subscription term, ICE MT will make SFG for Encompass available to Customer as described in Section 1. Customer will incur the fees for the SFG for Encompass services set forth during the checkout process.<\/li>\r\n<li><strong>End-Users.<\/strong>&nbsp;Without otherwise limiting any usage restrictions in the Agreement, \"End-Users\" for the purpose of SFG for Encompass means an unlimited number of Customer&rsquo;s employees and agents.<\/li>\r\n<li><strong>Proprietary Rights.<\/strong>&nbsp;For the avoidance of doubt, the materials in SFG for Encompass are protected by copyright, trademark, or other proprietary rights of ICE MT and its licensors, and SFG for Encompass is copyrighted as a collective work of ICE MT. Without otherwise limiting the \"Reservation of Rights\" section of the Agreement, Customer may download or copy the materials in SFG for Encompass only for Customer&rsquo;s reasonable internal reference use (e.g., no bulk downloading), provided that Customer must maintain all copyright, trademark, or other proprietary rights notices of ICE MT contained in such materials.<\/li>\r\n<li>** THE INFORMATION INCLUDED IN SFG FOR ENCOMPASS IS REPUBLISHED BY ICE MT WITH THE EXPRESS WRITTEN PERMISSION OF THE AGENCIES, COMPANIES, AND ORGANIZATIONS WHO HAVE AUTHORED AND OWN THIS INFORMATION. SFG FOR ENCOMPASS IS PROVIDED SOLELY BY ICE MT. THE AGENCIES, COMPANIES, AND ORGANIZATIONS DO NOT SPONSOR OR ENDORSE SFG FOR ENCOMPASS AND SPECIFICALLY DISCLAIM ANY LIABILITY OR RESPONSIBILITY FOR ITS ACCURACY OR COMPLETENESS. CUSTOMER ACKNOWLEDGES AND AGREES THE INFORMATION PROVIDED BY SUCH AGENCIES, COMPANIES, AND ORGANIZATIONS CHANGES FROM TIME TO TIME SUCH THAT A TOTAL RELIANCE ON THE INFORMATION IN SFG FOR ENCOMPASS AS AN AUTHORITATIVE EXPRESSION OF THIS INFORMATION IS INAPPROPRIATE AND CUSTOMER&rsquo;S FINAL RELIANCE SHOULD ALWAYS BE PLACED ON THE MANUALS, MEMORANDA, AND OTHER DOCUMENTATION DISTRIBUTED DIRECTLY BY SUCH AGENCIES, COMPANIES, AND ORGANIZATIONS.<\/li>\r\n<li><strong>Excluded Provisions.<\/strong> Customer acknowledges and agrees that the provisions in the Agreement regarding Backups and Disaster Recovery will only be applicable to SFG for Encompass after SFG for Encompass is hosted by Amazon Web Services. Until such time, ICE MT will perform backups at a secure facility operated in accordance with generally accepted industry standards. Further, Customer acknowledges and agrees that \"Customer Data\" as used in the Agreement does not apply to Customer&rsquo;s use of SFG for Encompass and Customer will not disclose nonpublic personal information in its use of SFG for Encompass.<\/li>\r\n<\/ol>          <\/div>\n                <\/div>\n            <\/div>           \n            <div class=\"modal-footer\">\n                <button type=\"button\" class=\"btn btn-secondary\" data-dismiss=\"modal\">Close<\/button>\n            <\/div>\n        <\/div>\n    <\/div>\n<\/div>","nextfunction":{"functionname":"openmodal","args":"modalhelper"}}
